ASBOs for car clampers

Councillors unanimously agreed to introduce Anti Social Behaviour Orders that can be dished out to car clampers.
The move was passed at last night's full council meeting.
It comes after concerns the Royal Borough is being plagued by firms charging tourists hundreds of pounds for returning late to private car parks.
Cllr Phill Bicknell (Con, Windsor Park) who passed the motion said the firms are making a fortune from victimising vulnerable visitors, which is damaging the reputation of the area as a tourist destination.
He said: "We have tried to put up warning signs in the town but still tourists fall foul, perhaps it is because they cannot read English. Either way they should not be victimised for turning up a few minutes late for their cars."
The council has already responded to the Department for Transport consultation on clamping by demanding an outright ban
Details of the borough's scheme have yet to be finalised.

- The council cannot make an ASBO, only a court can do that. If the clampers are acting lawfully it's hard to see how an ASBO could be made.
- It doesn't matter what the council pass, it's the magistrates' court that issues ASBOs, after evidence has been laid, not the local council. So think again councillors!
- If the charge is punitive then it's unlawful as only the state has the power to punish. Most of the release fees are unjustifiably high and inappropriate.
